Victory is operated by Cosmit Kettle Software OÜ (“we,” “our,” or “us”).

1. Acceptance of Terms

By downloading, installing, or using Victory (“the App”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App.

2. Description of Service

Victory is a mobile application that displays telemetry data from Gran Turismo 7 (GT7) and F1 25. The App provides real-time racing data visualization including but not limited to speed, lap times, tire data, fuel consumption, and other vehicle performance metrics.

3. User Responsibilities

You agree to:

• Use the App in compliance with all applicable laws and regulations
• Ensure you own or have permission to use Gran Turismo 7 or F1 25
• Not attempt to reverse engineer, modify, or tamper with the App
• Not use the App for any commercial purposes without prior written consent

4. Disclaimer

Victory is an unofficial third-party application and is not affiliated with or endorsed by the publishers or developers of Gran Turismo 7 or F1 25. All game names, trademarks, and copyrights are the property of their respective owners.

5. Limitation of Liability

The App is provided “as is” without warranties of any kind. We do not guarantee that the App will be error-free, uninterrupted, or meet your specific requirements. We shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use the App.

6. Data Accuracy

While we strive to provide accurate telemetry data, we do not guarantee the accuracy, completeness, or reliability of any data displayed in the App. The telemetry data is derived from Gran Turismo 7 or F1 25 and may be subject to game updates or changes.

7. Intellectual Property

All content in Victory, including but not limited to text, graphics, logos, and software, is the property of Victory or its licensors and is protected by copyright and other intellectual property laws.

8. Subscription and Payments

If Victory offers premium features through a subscription or one-time purchase:

• Subscriptions will automatically renew unless cancelled before the renewal date
• Web purchases are processed by Paddle as merchant of record
• App purchases are processed by the applicable app store
• Cancellations and refunds are governed by our Refund Policy, the policy of the platform that processed the purchase, and applicable law
• We reserve the right to modify subscription prices with notice

9. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms and Conditions or is harmful to other users, us, or third parties.

10. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the App or website. Your continued use of the App after changes constitutes acceptance of the modified terms.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Victory operates, without regard to its conflict of law provisions.
